Bradley Landscape Development Inc. ("Bradley Landscape," "we," "us," or "our") is a residential landscape design-build-maintain firm located at 1231 Orpheus Avenue, Encinitas, California 92024. We serve homeowners throughout coastal San Diego County.

This policy explains what personal information we collect, why we collect it, who we share it with, and the choices you have. It covers bradleylandscape.com, phone calls and text messages with our team, and information collected during design, construction, and maintenance services at your property.

2. Information We Collect

Information you give us directly

  • Contact details: your name, phone number, and email address.
  • Project information from our callback request form, including project type, service interest, budget range, and preferred callback date and time window.
  • Property information: your address, site conditions, existing landscape and irrigation details, and any plans, drawings, and photographs you share with us for design and documentation.
  • Scheduling and access information: gate codes, alarm codes, key or lockbox locations, pet information, and household access instructions you provide so we can access your property.
  • Billing information: invoice records, payment history, and contract documents.

Calls and messages

We record and transcribe some inbound and outbound telephone calls for quality assurance, training, scheduling accuracy, and record-keeping. See Section 4 for details.

If you give us your mobile number, we may send you text messages about scheduling, service visits, and project updates. See Section 6.

Information collected automatically on our website

  • Device and browser type, operating system, and screen size.
  • IP address and approximate general location derived from it.
  • Pages viewed, time on page, referring website, and search terms used to find us.
  • Cookies and similar identifiers used for analytics and advertising, as described in Section 5.

Information from other sources

We may receive information about you from architects, builders, landscape architects, general contractors, or other trade partners who refer clients or coordinate with us on your project.

3. How We Use Your Information

  • To respond to your consultation request and schedule callbacks and on-site visits.
  • To prepare designs, estimates, proposals, and project plans.
  • To perform construction and maintenance work and to access your property as scheduled.
  • To communicate with you about your project by phone, email, and text.
  • To invoice you and process payments.
  • To maintain internal records, including historical project documentation for properties we have maintained over many years.
  • To improve our website, understand how visitors find us, and measure the performance of our advertising.
  • To comply with legal, tax, licensing, insurance, and contractual obligations.

We do not sell your personal information for money. We do not share your personal information with third parties for their own independent direct marketing purposes.

4. Recorded and Transcribed Calls

Some calls with Bradley Landscape are recorded and transcribed. California law (Penal Code sections 632 and 632.7) requires the consent of all parties to record a confidential communication. You will be notified at the start of any recorded call. If you prefer not to be recorded, please let our team member know and the recording will be stopped, or the call will continue without it.

Recordings and transcripts are used for quality assurance, training, and accurate capture of project details. They are stored in our customer relationship management system and retained as described in Section 10.

5. Cookies, Analytics, and Advertising Technologies

Our website uses cookies and similar technologies. Some are necessary for the site to function. Others help us measure traffic and evaluate the performance of our advertising. Some of these technologies are operated by third parties who may receive information about your visit, including your IP address and the pages you viewed.

When you first visit our site, a consent banner will ask for your permission before any non-essential cookies or tracking tools are activated. 6. Text Messages

If you give us your mobile phone number, you may receive text messages from Bradley Landscape regarding scheduling, service visits, and project updates. Message and data rates may apply. Message frequency varies. Reply STOP to any message to opt out at any time, or HELP for assistance.

No mobile information will be sold or shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent will not be shared with any third parties.

7. How We Share Information

We share personal information only as described below.

  • Service providers and software vendors that operate our core business systems: Close (customer relationship management), n8n (workflow automation), LMN by Granum (landscape operations platform), our internally built field software, and QuickBooks Payments (billing and payment processing).
  • Trade partners on your project — such as architects, builders, general contractors, pool contractors, and subcontracted crews — where sharing your name, property address, and project details is necessary to coordinate the work.
  • Professional advisors including our attorneys, accountants, and insurers.
  • Government agencies and permitting authorities, for permits, inspections, or licensing compliance.
  • Law enforcement or other parties when legally required, or when necessary to protect rights, property, or safety.
  • A successor entity in connection with a merger, acquisition, or sale of business assets.

8. Photographs and Portfolio Use

We photograph properties before, during, and after our work for project documentation, quality control, and internal training. These records are part of our normal business files.

We may also wish to use photographs of completed projects in our portfolio, marketing materials, and social media, or to publish a client testimonial. We will ask your permission before using any identifiable image of your property or your name in public-facing marketing. If you have previously given permission and wish to withdraw it, please contact us using the information in Section 13 and we will remove the material.

9. Data Security

We use commercially reasonable administrative, technical, and physical safeguards to protect personal information in our care. Sensitive property access details — such as gate codes, alarm codes, and key or lockbox locations — are stored in encrypted form within our operational systems and are accessible only to team members who need them.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If you believe your information with us has been compromised, please contact us immediately.

10. Data Retention

We retain project records, designs, photographs, contracts, and billing records for as long as we serve you and afterward for as long as needed to meet our legal, tax, warranty, insurance, and licensing obligations. Because many maintenance relationships span decades, historical project files may be kept for the life of the client relationship.

Property access credentials are deleted when a service relationship ends.

Call recordings and transcripts are retained for 12 months, after which they are deleted.

11. Your California Privacy Rights

If you are a California resident, you have the following rights:

  • The right to know what categories of personal information we have collected, the sources, the purposes for which it is used, and the categories of third parties to whom we have disclosed it.
  • The right to request a copy of the specific personal information we hold about you.
  • The right to request deletion of your personal information, subject to exceptions for records we are required to keep for legal, tax, warranty, or contractual reasons.
  • The right to request correction of inaccurate personal information.
  • The right to opt out of the sharing of your personal information for cross-context behavioral advertising.
  • The right to limit our use and disclosure of sensitive personal information to what is necessary to provide the services you requested. Under California law, certain information we hold qualifies as sensitive personal information, including property access credentials (gate codes, alarm codes, key and lockbox locations) and financial account details. We use this information only as needed to perform your project and do not sell or share it.
  • The right not to receive discriminatory treatment for exercising any of these rights.

California's "Shine the Light" law (Civil Code section 1798.83) permits residents to ask us about personal information we have disclosed to third parties for their direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes, so there is nothing to report.

12. Children's Privacy

Our services are directed to homeowners and property owners and are not intended for children. We do not knowingly collect personal information from anyone under the age of 16. If you believe a child has submitted personal information to us, please contact us and we will delete it.

We will verify your identity before responding to a request about your personal information, typically by confirming details we already have on file — such as your service address and the phone number on your account. We will respond within 45 days and will notify you if we need additional time.

You may designate an authorized agent to make a request on your behalf. We may require written proof of the agent's authority before acting on the request.
